CAREERS PORTAL DISCLAIMER AND APPLICANT DECLARATION
By accessing, registering on, uploading documents to, and/or submitting an application through this Careers Portal ("Portal"), the applicant ("Applicant") expressly acknowledges, agrees, and declares as follows:
1. Accuracy and Authenticity of Information
The Applicant certifies that all information, statements, declarations, data, records, qualifications, employment history, references, identification documents, certificates, licenses, permits, photographs, and any other materials submitted through this Portal are true, accurate, complete, current, authentic, and not misleading in any respect.
The Applicant further confirms that:
- All uploaded documents are genuine, valid, and lawfully obtained;
- No information has been knowingly omitted, concealed, altered, manipulated, forged, fabricated, falsified, or misrepresented;
- All educational qualifications, professional certifications, employment history, remuneration details, and references are accurate and capable of independent verification by the Company.
2. Consent for Verification
The Applicant expressly authorizes the Company, its subsidiaries, affiliates, agents, consultants, professional advisers, background verification agencies, and authorized representatives to verify, investigate, authenticate, and validate any information submitted through the Portal, including but not limited to:
- Identity verification;
- Educational qualifications;
- Employment history and experience;
- Professional memberships and certifications;
- Criminal, civil, regulatory, and litigation records, where legally permissible;
- Reference checks;
- Immigration and work authorization status; and
- Any other information considered relevant for recruitment purposes.
3. Consequences of False, Misleading or Fraudulent Information
The Applicant acknowledges and agrees that submission of false, inaccurate, incomplete, misleading, forged, fabricated, manipulated, or fraudulent information or documentation shall constitute a material breach of this Declaration.
In such circumstances, the Company reserves the absolute and unrestricted right, without limitation, to:
- Reject, suspend, or disqualify the application at any stage of the recruitment process;
- Withdraw or revoke any offer of employment, appointment, internship, consultancy, or engagement;
- Immediately terminate employment or engagement without notice if such misrepresentation is discovered after commencement of employment;
- Report the matter to relevant governmental, regulatory, immigration, law enforcement, judicial, or professional authorities;
- Initiate civil, criminal, administrative, disciplinary, or other legal proceedings against the Applicant;
- Seek compensation, indemnification, damages, and recovery of all direct and indirect losses, costs, expenses, investigation costs, recruitment costs, onboarding expenses, legal fees, relocation expenses, and consequential losses incurred by the Company; and/or
- Exercise any other remedies available under applicable laws, Company policies, employment contracts, or equity principles.
4. Prohibited Conduct
The Applicant shall not:
- Submit false, misleading, fraudulent, forged, fabricated, altered, obscene material or unauthorized information or documentation;
- Misrepresent or conceal qualifications, employment history, identity, experience, remuneration, or references;
- Impersonate another person or submit an application on behalf of another person without the persons authorization;
- Attempt to gain unauthorized access to the Portal or associated systems;
- Interfere with, disrupt, overload, or compromise the functionality or security of the Portal.
5. Prohibition Against Malicious Files and Cyber Misconduct
The Applicant agrees not to upload, transmit, introduce, distribute, or otherwise submit through the Portal any file, software, script, code, executable program, macro, attachment, or other content that:
- Contains viruses, worms, trojans, ransomware, spyware, malware, logic bombs, or any malicious code;
- Is corrupted, intentionally damaged, encrypted without authorization, or otherwise designed to impair system functionality;
- Interferes with, disrupts, compromises, damages, or degrades the functionality of the Portal, Company systems, networks, databases, applications, servers, or data;
- Enables unauthorized access, hacking, phishing, denial-of-service attacks, data extraction, or any other unlawful cyber activity;
- Circumvents security controls, authentication measures, firewalls, or access restrictions.
The Applicant shall remain solely responsible for ensuring that all uploaded files are free from malicious software and are submitted in a readable, legible, secure, and non-corrupted format.
6. Liability for Malicious or Corrupted Uploads
Where the Company reasonably determines that any uploaded file, attachment, document, or content contains malicious code, malware, viruses, obscene material, corrupted data, unauthorized scripts, or any element capable of causing disruption, compromise, or damage to Company systems or third-party systems, the Company reserves the right to:
- Immediately reject, quarantine, delete, or remove such submission;
- Restrict, suspend, or permanently block the Applicant's access to the Portal;
- Conduct digital forensic investigations and preserve electronic evidence;
- Report the matter to relevant authorities;
- Commence civil, criminal, or administrative proceedings against the Applicant; and
- Recover from the Applicant all losses, damages, remediation expenses, forensic investigation costs, business interruption losses, regulatory penalties, legal fees, professional costs, and any other financial consequences arising directly or indirectly from such act.
7. Cyber Security Compliance and Cross-Border Enforcement
The Applicant acknowledges that the Company operates internationally and that use of the Portal may be subject to the laws of multiple jurisdictions, including but not limited to the laws of the United Arab Emirates and, where applicable, the laws of the Republic of Zambia.
The Applicant expressly agrees that any act involving unauthorized access, transmission of malicious software, destruction, suppression, alteration, manipulation, corruption, interception, interference with, or disruption of Company information systems, databases, networks, applications, or electronic communications may constitute a criminal offence.
Without limiting any other rights available to the Company, the Applicant acknowledges that such conduct may be investigated and prosecuted under:
- Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes of the United Arab Emirates and related applicable legislation; and
- The Cyber Crimes Act, 2025, the Cyber Security Act, 2025, and any successor legislation in force in the Republic of Zambia.
The Applicant further acknowledges that cyber offences including unauthorized access to computer systems, introduction or dissemination of malicious software, unauthorized interference with computer systems or data, electronic fraud, destruction or alteration of electronic information, and other cyber-related offences may attract substantial fines, imprisonment, or both, depending on the nature and severity of the offence.
The Company may, without prior notice:
- Preserve and retain electronic records, metadata, access logs, IP addresses, timestamps, uploaded files, communications, and other digital evidence;
- Conduct internal and external forensic investigations;
- Report suspected unlawful activity to competent law enforcement agencies, cyber security agencies, regulators, or judicial authorities in the UAE, Zambia, or any other relevant jurisdiction;
- Cooperate fully with governmental authorities in investigations and prosecutions;
- Commence civil proceedings for recovery of losses, damages, investigation costs, business interruption losses, legal fees, and consequential damages; and
- Seek injunctive relief, compensation, indemnification, and any other remedies available under applicable law.
Any attempt to upload infected, malicious, corrupted, encrypted, unauthorized, obscene or harmful files shall constitute a material breach of this Declaration and may result in immediate disqualification, permanent exclusion from the Company's recruitment systems, civil liability, criminal prosecution, and financial recovery proceedings.
8. Intellectual Property and Third-Party Rights
The Applicant warrants that all submitted materials do not infringe any copyright, trademark, patent, confidentiality obligation, privacy right, or other proprietary right of any third party.
The Applicant agrees to indemnify and hold harmless the Company against any claims, liabilities, losses, damages, penalties, costs, or expenses arising from any breach of this warranty.
9. Reservation of Rights
The Company reserves the unrestricted right to:
- Monitor, screen, audit, and review all submissions;
- Remove, reject, quarantine, or delete any uploaded material;
- Conduct security screening on all files and attachments;
- Retain records and digital logs for investigation purposes;
- Share information with competent authorities where required by law or where necessary to protect legitimate business interests.
10. Indemnity
The Applicant agrees to fully indemnify, defend, and hold harmless the Company, its shareholders, directors, officers, employees, affiliates, agents, consultants, and representatives against any and all claims, actions, liabilities, damages, losses, penalties, fines, costs, expenses, and legal fees arising out of or relating to:
- False or misleading information submitted by the Applicant;
- Submission of forged or unauthorized documents;
- Upload of malicious, infected, corrupted, or unlawful files;
- Violation of applicable laws, regulations, Company policies, or third-party rights; or
- Any negligent, fraudulent, intentional, or unlawful act or omission by the Applicant.
11. Governing Law and Jurisdiction
This Disclaimer and Applicant Declaration shall be governed by and construed in accordance with the laws of the United Arab Emirates.
Any dispute arising out of or in connection with the use of this Portal, submission of an application, or breach of this Declaration shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
12. Applicant Acknowledgement
By selecting the "I Agree" checkbox, creating an account, uploading documents, or submitting an application through this Portal, the Applicant confirms that:
- The Applicant has read and understood this Disclaimer and Applicant Declaration;
- The Applicant voluntarily agrees to be legally bound by its terms and conditions; and
- The Applicant acknowledges that violation of these provisions may result in disqualification, termination, legal proceedings, financial recovery actions, and/or criminal prosecution.
